These Terms of Service ("Terms") govern your use of the MyOpenClaw deployment service ("Service") operated by MyOpenClaw ("we", "us", or "our"). By using the Service, you agree to these Terms.
Summary: You get a personal OpenClaw instance for the subscription period you pay for. Use it responsibly, don't abuse it, and we'll keep it running. Your instance is yours to control within these Terms.
1. Service Description
MyOpenClaw provides a deployment service that allows you to:
- Deploy and manage your own OpenClaw AI instance
- Access your instance via Telegram and a custom subdomain
- Configure and customize your instance
- Install skills and extensions
2. Third-Party Software and AI Disclaimer
IMPORTANT: We provide hosting and deployment infrastructure only. We are NOT the developers, maintainers, or owners of OpenClaw software. OpenClaw is third-party open-source software subject to its own license and terms.
2.1 Nature of Our Service
MyOpenClaw is a hosting and deployment service. We:
- Provision and manage server infrastructure
- Automate the installation of OpenClaw software
- Provide connectivity via Telegram and custom subdomains
- Handle billing and subscription management
We do NOT:
- Develop, maintain, or control the OpenClaw software
- Guarantee the functionality, accuracy, or security of OpenClaw
- Control updates, changes, or deprecations to OpenClaw
- Provide warranties for third-party software behavior
2.2 OpenClaw Software
OpenClaw is open-source software provided under its own license. By using our Service, you acknowledge that:
- OpenClaw software is provided "AS IS" without any warranty
- We are not responsible for bugs, errors, or security vulnerabilities in OpenClaw
- OpenClaw may be updated by its maintainers, which may change functionality
- You accept and agree to OpenClaw's license terms
- We have no control over OpenClaw's development roadmap or decisions
2.3 AI-Generated Content
Your OpenClaw instance uses artificial intelligence to generate responses. You understand and agree that:
- AI-generated content may be inaccurate, incomplete, or misleading
- AI may produce biased, offensive, or inappropriate content
- AI outputs should not be relied upon for professional advice (legal, medical, financial, etc.)
- You are solely responsible for reviewing and verifying all AI-generated content
- We are not liable for any decisions made based on AI outputs
- AI behavior may change due to updates to underlying models or OpenClaw software
2.4 Third-Party AI Providers
OpenClaw may integrate with third-party AI providers (such as OpenAI, Anthropic, Google, or others). You acknowledge that:
- You must comply with the terms of service of any AI provider you use
- We are not responsible for outages, rate limits, or policy changes by AI providers
- AI provider API costs and usage limits are your responsibility
- Third-party providers may log, store, or use data sent to their APIs
- Service interruptions caused by third-party providers are not our fault
3. Account Requirements
To use the Service, you must:
- Have a valid Telegram account
- Be at least 13 years of age (or the minimum age in your jurisdiction)
- Provide accurate information when requested
- Maintain the security of your Telegram account
4. Subscriptions and Payments
4.1 Subscription Periods
We offer various subscription periods (e.g., 1 day, 7 days, 30 days). Your instance remains active for the duration of your paid subscription period.
4.2 Payment Methods
We accept payments via:
- Telegram Stars
- Crypto Pay (cryptocurrency)
4.3 Subscription Expiration
When your subscription expires:
- Your instance will be stopped
- You will have a 24-hour grace period to renew
- After the grace period, your instance and all data will be permanently deleted
4.4 Refunds
Refunds are handled on a case-by-case basis. You may request a refund within 24 hours of payment if:
- The Service failed to deploy your instance
- A technical issue on our end prevented you from using the Service
Refunds are not available for:
- Change of mind
- Issues caused by your own configuration
- Partial subscription periods
- Bugs, errors, or limitations in OpenClaw software
- AI response quality, accuracy, or appropriateness
- Third-party AI provider outages or issues
5. Acceptable Use
You agree to use the Service responsibly. You may NOT use the Service to:
- Violate any applicable laws or regulations
- Generate, store, or distribute illegal content
- Harass, abuse, or harm others
- Send spam or unsolicited messages
- Attempt to gain unauthorized access to other systems
- Run cryptocurrency mining or similar resource-intensive operations
- Host malware, phishing sites, or other malicious content
- Violate intellectual property rights of others
- Impersonate others or misrepresent your identity
- Circumvent resource limits or abuse the infrastructure
6. Your Responsibilities
You are responsible for:
- All activity on your instance
- Content generated or stored by your instance
- API keys and credentials you provide to your instance
- Ensuring your use complies with third-party terms (e.g., AI provider terms)
- Backing up any data you wish to preserve before subscription expiration
7. Service Availability
We strive for high availability but do not guarantee 100% uptime. The Service may be temporarily unavailable due to:
- Scheduled maintenance (we will notify you when possible)
- Infrastructure issues at our hosting provider
- Security incidents or attacks
- Force majeure events
8. Instance Resources
Each subscription tier includes specific resources (CPU, RAM, storage). You agree to:
- Use resources within the limits of your subscription tier
- Not attempt to bypass resource limitations
- Upgrade your subscription if you need more resources
9. Referral Program
If you participate in our referral program:
- You earn commission on payments from users you refer
- Referral fraud or abuse will result in forfeiture of earnings
- We reserve the right to modify or terminate the program
- Minimum withdrawal amounts may apply
10. Intellectual Property
You retain ownership of:
- Content you create or upload to your instance
- Custom configurations and prompts you develop
We retain ownership of:
- The Service, deployment infrastructure, and related technology
- The MyOpenClaw brand, logos, and trademarks
11. Termination
11.1 By You
You may stop using the Service at any time. No refunds are provided for unused subscription time.
11.2 By Us
We may suspend or terminate your access if:
- You violate these Terms
- You engage in abusive behavior
- Your instance is used for illegal activities
- You fail to pay for your subscription
For serious violations, termination may be immediate without refund.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted or error-free
- The Service will meet your specific requirements
- Any defects will be corrected
12.1 Third-Party Software Disclaimer
OPENCLAW AND ALL THIRD-PARTY SOFTWARE DEPLOYED THROUGH OUR SERVICE ARE PROVIDED "AS IS" WITHOUT ANY WARRANTY. WE EXPRESSLY DISCLAIM:
- Any warranty that OpenClaw will function correctly or securely
- Any warranty regarding the accuracy, reliability, or completeness of OpenClaw
- Any responsibility for security vulnerabilities in OpenClaw or its dependencies
- Any liability for data loss, corruption, or breaches caused by OpenClaw software
12.2 AI Content Disclaimer
AI-GENERATED CONTENT IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY. WE EXPRESSLY DISCLAIM:
- Any warranty regarding the accuracy, truthfulness, or reliability of AI outputs
- Any responsibility for harmful, offensive, biased, or illegal content generated by AI
- Any liability for decisions or actions taken based on AI-generated content
- Any representation that AI outputs constitute professional advice of any kind
YOU USE AI-GENERATED CONTENT ENTIRELY AT YOUR OWN RISK.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, or consequential damages
- Loss of profits, data, or business opportunities
- Damages exceeding the amount you paid in the 3 months before the claim
14. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Content generated or stored on your instance
- Your violation of any third-party rights
15. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes through our Telegram bot. Continued use after changes constitutes acceptance.
16. Governing Law
These Terms are governed by applicable law. Any disputes shall be resolved in the appropriate courts of jurisdiction.
17. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
